Partner Visa
Partner Visas have replaced Spouse Visas and Interdependency Visas for spouses and de facto partners (including same-sex partners) of Australian citizens, permanent residents or eligible New Zealand Citizens.
Same-sex de facto partners and their children are recognised as family members of primary visa applicants and are eligible to apply for all visas available to opposite-sex partners, including student, business, skilled and humanitarian visas.
There are five (5) subclasses of visas in the Partner category.
- 300 Prospective Marriage visa. This is known simply as the fiancé visa and is appropriate for a person who is engaged but not yet married to an Australian Citizen, permanent resident or ENZ.
- 309 Spouse Provisional visa. This is for those applicants who are married or in a defacto relationship with an Australian Citizen, permanent resident or ENZ and you are outside of Australia at the time of application.
- 100 Spouse Permanent visa. This is a permanent visa for an applicant who is married to or in a defacto relationship with an Australian Citizen, permanent resident or ENZ.
- 820 Spouse Temporary visa. This is a temporary visa for a person who is married to or in a defacto relationship with an Australian Citizen, permanent resident or ENZ. This visa is for applicants who are in Australia at the time of their application.
- 801 Spouse Permanent visa. This is a permanent visa for applicants who are married to or in a defacto relationship with an Australian Citizen, permanent resident or ENZ.
